Maybe I'm just old fashioned, but I hear that as a choice between a nice walk in the park and being mauled by an irate wolverine. If one is constitutional and the other isn't, the constitutional one is the only option. Period. Anything our government does that is unconstitutional is illegal. Why is this so hard to understand?
Because it has been ignored so completely for so long that most have become inured to it. When the Speaker of the House can say "Constitution? Really? Next question" the battle is lost. So little of what the fed gov does is constitutional. So much is lumped under "promote the general welfare," despite the fact that Madison and Jefferson are both on record as saying that clause applies only to the powers specifically granted to the Federal Government (see: http://www.humanevents.com/2013/05/29/unsustainable-and-unconstitutional-general-welfare-spending-2/ ) Apparently the Tenth Amendmant does not have the power the rest do.

ReplyDeleteBecause legality is trumped by 'what is right/fair" in the mind of so many.
